§ 1 Conclusion of contract

(1) Scope of the GTC
These General Terms and Conditions (GTC) are binding for all contracts between LC Health & Lifestyle GmbH (hereinafter: égoïste) and its customers, unless otherwise agreed. Customers are all persons who acquire or have acquired the right to use the range of courses and events in accordance with § 2. Deviating agreements must always be made in writing.
(2) Binding nature and deviations
The version of the GTC valid at the time of the conclusion of the contract is authoritative. The GTC are published on the company's website and in the bsport app. By concluding the contract, the customer confirms that he has taken full note of the GTC and accepts them. Changes to the GTC will be communicated to the customer by e-mail. Deviating terms and conditions of the client will only be accepted if they have been agreed in writing between the client and the company.
(3) Conclusion of the contract and booking
A contract between the company and the customer is concluded by offer and acceptance in accordance with §§ 145 ff. BGB (German Civil Code). The registration or booking of Pilates and yoga courses, workshops, retreats, training and further education or other services and events (hereinafter referred to as "Events") constitutes a binding offer by the Customer. The registration/booking can be made via the bSport booking platform and, in exceptional cases, by e-mail, letter or a registration form on site. Acceptance by the Company shall be effected by sending a confirmation of registration or payment by e-mail or by signing the contract. Participation in booked events is only possible after full payment has been made, unless otherwise agreed. The confirmation of a place in a workshop only becomes binding once the respective fees have been paid in full.
§ 2 Subject matter of the contract and course offer
(1) Scope and implementation of the course offering
The company offers various Pilates and yoga courses (individually or in groups and in
different levels of difficulty), workshops as well as training and further education. The offer also includes retreats. These events are held in the égoïste Pilates & Yoga Studio or in specially rented premises.
(2) Opening hours and changes to course offerings
The current office and course times as well as the range of courses and events are published on the company's website (www.egoiste-studio.de) and updated regularly. The Company reserves the right to conduct training and further education courses at a reasonable distance from the Studio if required. Customers will be informed of the location of the event at least one week before the start. Changes to the opening times, the range of courses on offer and the teachers or instructors will also be announced on the website and in the studio. If the number of participants for an event is less than five up to 14 days before the start, the company reserves the right to cancel the event. Affected customers will be informed by e-mail and can receive a free replacement booking or a refund of fees.
(3) Monthly and points cards; one-way tickets
The company offers individual drop-ins and credit packages for booking the Pilates and yoga courses on offer. The validity of the respective packages is shown at the time of purchase. Drop-ins and credit packages cannot be used for workshops, training and further education events or retreats. Credit packages are personalized and non-transferable.
§ 3 Memberships
(1) égoïste offers both 3-month and 6-month memberships. Both memberships are automatically extended by the respective period unless they are terminated in due time. Cancellation is possible in writing up to 7 days before the end of the month. Unused credits expire at the end of the month and cannot be carried over to the next month. Membership can only be changed at the beginning of the next month. A refund for unused months is not possible. Memberships can be paused if the number of pause days is communicated in writing at least 7 days in advance. Please note that after the pause, the next billing and all future payments will be postponed by the number of pause days and the expiration date of the pass will be extended accordingly. The break remains valid during the interruption.
(2) Change of membership data / specification of an e-mail address
The member is obliged to provide a valid e-mail address for communication with égoïste when concluding the contract. Important notifications (such as reminders or changes to the GTCs) can be sent either by post or e-mail to the member's last-mentioned address. The member must notify égoïste immediately of any changes to relevant contractual data, such as name, address, e-mail address and bank details.
(3) Non-transferability of membership / identity check
Membership of égoïste is non-transferable. Members may not pass on their credits to third parties. To ensure that only the member uses the credits, égoïste may carry out an identity check, for example by checking a photo ID.
(4) Extraordinary termination
égoïste reserves the right to extraordinarily terminate a membership if the user violates rules of conduct, such as inappropriate behavior, repeated rule violations or misuse of the booking platform. In this case, there will be no refund of fees already paid.
§ 3 Prices, terms of payment and offsetting
(1) Price list
The participation fees and information on booking the courses and events on offer are listed in the company's current price list, which can be viewed on the website www.egoiste-studio.de and in the studio.
(2) Due date of the fees
Unless otherwise agreed, the participation fees are due immediately upon conclusion of the contract.
(3) Payment methods
Payment of the participation fees can be made by bank transfer, EC card payment, credit card payment or voucher. Online payment systems or credit card payment are also possible for online bookings via bSport.
(4) Discounts and promotions
Discounts and promotions are limited to the specified period of validity. Promotional vouchers are only recognized in the original. A combination of several discounts is excluded.
(5) Offsetting
The customer may only offset against claims of the company if his counterclaims are legally established, recognized or undisputed.
§ 4 Non-participation and termination
(1) Termination, default and non-participation
There is no entitlement to a refund of participation fees in the event of cancellation, failure to attend or non-participation in booked events. A 12-hour cancellation period applies to course bookings. Cancellations within this period will not be refunded. Certificates of attendance or completion will only be issued for fully attended training courses.
(2) Statutory rights of termination and withdrawal
Customers' statutory rights of termination and withdrawal remain unaffected.
(3) Termination without notice for good cause
The contract can be terminated at any time without notice for good cause. Good cause exists if the continuation of the contractual relationship is unreasonable, e.g. if the customer repeatedly fails to comply with their obligations to cooperate or in the event of breaches of the law and common decency in the studio.
§ 5 Liability
(1) Limitation of liability
The Company shall only be liable for damages caused by gross negligence or intent or in the event of a breach of material contractual obligations (cardinal obligations).
(2) Exclusion of liability
Any further liability of the company is excluded.
(3) Scope of liability
In the event of a breach of material contractual obligations without gross negligence or intent, liability shall be limited to the typically foreseeable damage.
(4) Liability for injury to life, limb and health
The limitations of liability shall not apply in the event of injury to life, limb or health or in the event of claims under the Product Liability Act.
(5) Liability for items brought along
The company accepts no liability for any property or valuables brought into the studio. Customers should not bring valuables into the studio. Lockable lockers are provided by the Company; they are not supervised. The Company is not liable for items stolen from the lockers unless the Company or its representatives have acted with intent or gross negligence. Valuables are not to be stored in the lockers.
(6) Participation in full health
Customers should only take part in the courses if they are in full health and should consult a doctor beforehand if they have any health problems and inform the instructor. égoïste is not liable for any injuries or accidents that occur during the courses. Participation is at your own risk.
(7) Technical availability:
No guarantee is given for the continuous availability of the app, website or the bsports booking platform.
§ 6 Copyrights
(1) Copyright in materials
The copyright to all scripts and publications is held by the company. Reproduction or disclosure to third parties is prohibited without written permission.
(2) Contractual penalty for breaches
Violations of copyright law will be punished with a contractual penalty of EUR 3,500. Further claims for damages remain unaffected.
(3) Consent to photo and film recordings
Customers agree that photos or film recordings made during the courses may be used for audiovisual and social media without remuneration.
§ 7 Data protection
(1) Data collection and processing
The company collects, processes and stores personal data for contract processing and is legally obliged to store this data.
(2) Confidentiality and disclosure
The data will be treated confidentially and only passed on to third parties with the express consent of the customer.

Customers are obliged to inform the company of any changes to their data.
§ 8 Final provisions
(1) Place of performance and jurisdiction
The place of performance for all services is Düsseldorf, except for training and further education events and retreats. The place of jurisdiction for all disputes is Düsseldorf, whereby the right to sue the contractual partner at its general place of jurisdiction remains unaffected.
(2) Online dispute resolution
The European Commission provides an online dispute resolution platform that customers can use if they have made an online purchase and are based within the EU.
(3) Applicable law
German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
(4) Severability clause
Should individual provisions of these GTC be invalid, the remainder of the contract shall remain valid. The invalid provisions shall be replaced by the statutory provisions.
(5) Right of withdrawal
Consumers have a right of withdrawal in accordance with § 312 BGB if the contract was concluded using

Appendix 1: Cancellation policy
Consumers have the right to cancel the contract within fourteen days without giving reasons.

Consequences of revocation
In the event of withdrawal, all payments, including delivery costs (with the exception of additional costs for a type of delivery other than the cheapest standard delivery), will be refunded immediately and at the latest within fourteen days. The same means of payment used for the original transaction will be used for the refund, unless expressly agreed otherwise. No fees will be charged for the repayment. If the customer has requested that the services should commence during the withdrawal period, a reasonable amount shall be paid which corresponds to the proportion of the services provided up to the time of withdrawal compared to the total scope of the services provided for in the contract.
Loss of the right of withdrawal
The right of withdrawal expires before the end of the withdrawal period if the services have been provided in full at the express request of the customer.
Appendix 2: Our Wellbeing Policy
BE READY
Please be in the studio 10 minutes before the class starts. Out of respect for all participants, our classrooms will be closed at the start of the class. If you are late, your booking will be forfeited and cannot be refunded.
CANCELLATION
You can cancel your course up to 12 hours in advance. Please use our booking portal for this.
PARKING
There is no direct parking in front of our studio. You can park in the surrounding streets, but please note that parking fees apply. Alternatively, you can come by public transport. The stops Benrather Straße (U71, U72, U73 and U83), Heinrich-Heine-Allee (U79) and Graf-Adolf-Platz (streetcars 706, 708 and 709) are within walking distance.
WHAT TO BRING
All you need to take part in the course is a comfortable sports outfit. The rest of the equipment is provided by égoïste. Grippy socks or a cool drink can be purchased at our Matcha Bar.
NO SHOES
égoïste is a shoe-free zone. Please take your shoes off in the changing area and put them in the compartments provided. For training on the reformer, you will need Gripps socks, which you can bring yourself or buy from us.
LANGUAGE
Our trainers speak German and English. If a course is entirely in English, you will find the designation EN after the class name in our timetable.
DUTY OF CARE
If you have any health restrictions, please inform your trainer before the lesson. We will be happy to advise you if you are unsure about your training.
RESPECT
Please turn off your cell phone or set it to flight mode during the courses.
HYGIENE
We leave the room clean and tidy for the next participants. Used equipment is cleaned independently by each participant at the end of the lesson. Suitable cleaning agents are available in the studio for this purpose.
